A hot issue in Canada
has been whether the ruling in Paxton v
Ramji relating to duties of a physician to a fetus, has impacted on
duties owed in birth trauma cases. The defence bar has been taking this issue
forward in British Columbia, and more recently
in Ontario. I
argued the issue under our rules to determine a point of law, that is, did the
defendants owe a duty to the fetus while in utero. The decision of the court in
Liebig v Guelph General Hospital et al
is attached. The court ruled the defendants do owe such a duty.
